{"id":1196,"date":"2024-10-18T11:39:23","date_gmt":"2024-10-18T09:39:23","guid":{"rendered":"https:\/\/yepeslegal.com\/short-term-rentals-in-fraud-of-law-consequences\/"},"modified":"2026-02-08T16:43:44","modified_gmt":"2026-02-08T15:43:44","slug":"short-term-rentals-in-fraud-of-law-consequences","status":"publish","type":"post","link":"https:\/\/yepeslegal.com\/es\/short-term-rentals-in-fraud-of-law-consequences\/","title":{"rendered":"Alquileres de temporada en fraude de ley: Consecuencias"},"content":{"rendered":"\n<p>La Sentencia n.\u00ba 21\/2023 de la Audiencia Provincial de M\u00e1laga, Secci\u00f3n Quinta, de 23 de enero, recoge un caso de contrato de alquiler de temporada concertado en fraude de ley, pues pese a tratarse en realidad de un alquiler de vivienda habitual (y ser, por lo tanto, un contrato de arrendamiento de vivienda de los regulados en la Ley de Arrendamientos Urbanos), se hizo bajo la forma de alquiler de temporada, en un intento por parte del arrendador de burlar la aplicaci\u00f3n de la normativa vigente sobre duraci\u00f3n m\u00ednima de los contratos, concatenando incluso en el tiempo hasta tres contratos sucesivos, desde el a\u00f1o 2016 hasta el 2019.<\/p>\n\n\n\n<p>Este tipo de maniobras fraudulentas no sirven en absoluto para eludir la aplicaci\u00f3n de la legislaci\u00f3n vigente en materia de arrendamiento de vivienda. Si un arrendamiento recae sobre una edificaci\u00f3n habitable cuyo destino primordial es satisfacer la necesidad permanente de vivienda del arrendatario, estamos ante un contrato de arrendamiento de vivienda, de los definidos en el art\u00edculo 2\u00ba de la LAU y cuya duraci\u00f3n m\u00ednima obligatoria para el arrendador es de cinco a\u00f1os contados a partir de su fecha. Ello independientemente de que se llame \u201ccontrato de temporada\u201d,&nbsp; se diga que su duraci\u00f3n es de once meses, o incluya cualquier cl\u00e1usula de renuncia de derechos que habr\u00e1 que considerar nula por aplicaci\u00f3n del art\u00edculo 9 de la LAU.<\/p>\n\n\n\n<p>En el caso que contempla la sentencia citada, la Audiencia confirma que el contrato no es de temporada, sino de arrendamiento de vivienda, por lo que se aplican al mismo las pr\u00f3rrogas establecidas en la LAU y, en consecuencia, contin\u00faa en vigor.<\/p>\n\n\n\n<p><a
